By accessing this website (the “Site”), enrolling in the PassYourNCLEX™ NCLEX-RN preparation course (the “Course”), or downloading associated study materials and resources (collectively, the “Products”), you agree to be legally bound by these Terms and any applicable policies incorporated by reference, including without limitation our Privacy Policy and Refund Policy.If you do not agree to be bound by these Terms, you may not access, use, or purchase from PassYourNCLEX.com. These Terms constitute a binding agreement between you (“User,” “You”) and PassYourNCLEX.com.

1. Eligibility and Scope of Access

1.1. You must be at least 18 years of age and legally capable of entering into binding contracts under applicable law to access or purchase Products from the Site.

1.2. Upon purchase, Users are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Course and downloadable materials for personal, non-commercial study purposes only. All rights not expressly granted herein are reserved by PassYourNCLEX.com.

1.3. Sharing login credentials, reselling course content, screen-recording lessons, or distributing copyrighted materials to any third party is strictly prohibited and shall constitute a material breach of this Agreement, subject to immediate account termination and legal recourse.

2. Intellectual Property

2.1. All content available through the Site, including text, images, videos, software, documents, design, branding, trademarks, and logos, are the intellectual property of PassYourNCLEX.com or its licensors, and are protected by United States and international copyright and intellectual property laws.

2.2. No content on the Site or within the Course shall be copied, reproduced, republished, transmitted, publicly displayed, adapted, translated, or distributed in any form without prior written consent of the Company.

2.3. Violation of this provision may result in both civil and criminal liability and shall constitute grounds for permanent account suspension without refund or notice.

3. User Responsibilities

3.1. You agree to use the Site and Course solely for lawful purposes and in accordance with these Terms. You shall not use the Site:

• To violate any applicable federal, state, or local laws;
• To interfere with or damage the Site or its servers through hacking, malware, or any other unauthorized means;
• To misrepresent your identity or impersonate any person or entity;
• To engage in harassment, abusive language, or disruptive conduct in any interactive components (e.g., forums or webinars).

3.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.

4. Refund and Money-Back Guarantee Policy

4.1. Study Materials and Downloadable Products

All sales of downloadable guides, PDFs, or cheat sheets are final and non-refundable. Due to the digital nature of these products, no refunds or exchanges shall be granted once delivery is confirmed.

4.2. NCLEX-RN Course Refund Guarantee

We offer a limited money-back guarantee for enrollees of the The NCLEX-RN® Prep Course who do not pass the NCLEX-RN within their 2nd attempt after full completion of the Course, subject to all the terms, conditions, and limitations below.

To qualify for a full refund, the following conditions must be met:

• ✅ User must have enrolled in the Course via direct purchase from PassYourNCLEX.com (not via third-party bundles, group licenses, or promotions).
• ✅ User must have completed 100% of the Course content, including all core lessons, quizzes, and both full-length CAT-style practice exams.
• ✅ The NCLEX-RN exam must have been taken within 30 calendar days of Course completion.
• ✅ User must provide official documentation of failure, including the Candidate Performance Report (CPR) issued by the National Council of State Boards of Nursing (NCSBN).
• ✅ The refund request must be submitted in writing within 7 days of receiving the official NCLEX exam result.

The following conditions disqualify a User from refund eligibility:

• ❌ Incomplete course participation, skipped modules, or unverified exam performance
• ❌ NCLEX taken more than 30 days after course completion
• ❌ Fraudulent submissions, altered documents, or false representation of exam status
• ❌ Use of a shared or compromised account
• ❌ Previous refund issued by PassYourNCLEX for any course or product

All refund decisions are made at the sole discretion of PassYourNCLEX.com and are final. Users found in violation of refund policies may be barred from future enrollment or legal action may be pursued.

5. Disclaimers

5.1. No Guarantee of Outcome: While our course is designed to maximize preparedness, we make no warranties or guarantees—express or implied—regarding your licensure exam outcome, employment, or readiness to practice. Performance is contingent on personal study habits, educational background, and test-day variables.

5.2. Modifications: We reserve the right to modify, enhance, replace, or retire portions of the Course or Site without notice. You understand that access to specific features is not guaranteed in perpetuity.

5.3. System Availability: While we aim for 99% uptime, we do not warrant uninterrupted access to the Course. Temporary outages for updates, maintenance, or third-party disruptions may occur.

5.4. Editorial Representation: Certain images, profiles, and related content appearing on PassYourNCLEX.com constitute original editorial works and may incorporate composite, simulated, or fictionalized elements. Video lessons contained within the course may be produced in whole or in part with the assistance of artificial intelligence. Such content is provided solely for educational and illustrative purposes, including the depiction of clinical scenarios, instructional methodologies, and student perspectives, and is designed to protect the privacy and confidentiality of individuals. All such materials are and shall remain the exclusive intellectual property of PassYourNCLEX.com. Educational resources, study guides, and course content are authored and/or reviewed by duly licensed medical professionals to ensure accuracy and conformity with the current NCLEX-RN® and NCLEX-PN® test plans.

6. Limitation of Liability

To the fullest extent permissible by law, PassYourNCLEX.com shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising out of:

• Use or inability to use the Course or Site;
• Errors, omissions, or inaccuracies in the content;
• Unauthorized access to or alteration of your data;
• Any decision made or action taken by you based on information from the Site.

Our total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by you to the Company in the twelve (12) months preceding the claim.

7. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved through binding arbitration conducted under the rules of the American Arbitration Association (AAA), in El Paso County, State of Texas. You hereby waive the right to any class action.

8. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
